The Center for Public Integrity: Finance industry makes up nearly ...

Last summer, hedge fund pioneer Julian Robertson made the maximum $2,500 contribution to Mitt Romney's campaign for the Republican presidential nomination. With a net worth somewhere north of $2 billion, it seemed as though he could do a lot more.

Thanks to the Supreme Court's Citizens United decision, he did.

Robertson gave $1.25 million to Restore Our Future, a super PAC that has underwritten a relentless advertising campaign ripping Romney's opponents. That's 500 times the contribution he made in June.

Robertson is not alone. Of the $43.2 million raised by the attack PAC, $20.5 million, or 48 percent, came from finance industry donors, according to an analysis of Federal Election Commission data by the Center for Public Integrity.

At least $13.5 million came from private equity firms ($7 million) and hedge funds ($6.5 million) while most of the rest came from investment banks and other asset managers. So-called "non-bank lenders" that run storefront cash-for-title and payday lending operations gave the super PAC $437,500, according to the analysis.

Restore Our Future is by far the best-funded of the super PACs backing presidential candidates in the 2012 election. The super PAC closed out the month of February with $10.5 million cash on hand, more than Romney's campaign, according to FEC records.

Romney, a former private equity executive, wants to repeal the Dodd-Frank Wall Street Reform and Consumer Protection Act and has said he is opposed to doing away with a tax loophole that has helped make private equity and hedge fund managers enormously wealthy over the years.

The finance industry's total percentage of contributions would be greater were it not for homebuilder and long-time Republican donor Bob Perry, who gave $3 million to the super PAC in February, bringing his total contributions to $4 million.

Romney has battled the perception that he is out of touch with working-class Americans. The list of donors to his super PAC isn't going to help much; the average contribution was a little more than $83,000.

High court changes the game

The 2010 Citizens United Supreme Court decision led to the creation of super PACs, which can accept unlimited donations from corporations, labor unions and wealthy individuals and use the funds to pay for advertising and other campaign expenses, as long as they do not coordinate with candidates.

Hedge funds are private, largely unregulated investment pools that are typically overseen by a single manager and usually available only to high-value investors, like wealthy individuals, private banks, pensions, corporate treasuries and endowments. Private equity companies are more hands-on but are also mostly unregulated and attract the same type of investor.

The firms and their trade associations share Romney's view that Dodd-Frank should be repealed. Investment managers also want to make sure "carried interest," which accounts for much of their income, as well as Romney's, continues to be taxed at the modest capital-gains rate of 15 percent.

Romney opposed changes in taxation of carried interest when he ran in 2007, although his current position is less clear.

Romney is the top choice of the securities and investment industry. His campaign has received $6.8 million with President Barack Obama a distant second at $2.3 million, according to the Center for Responsive Politics. The pro-Obama super PAC, Priorities USA Action, has collected $175,000 from the industry.

Wall Street investment bank Goldman Sachs' employees have given $670,000 to the super PAC. According to the Center for Responsive Politics, Goldman employees have given more than $535,000 to the Romney campaign itself -- the largest amount contributed by employees from any one company.

Neither the Romney campaign nor Restore Our Future responded to requests for comment for this story.

Top donors

Robertson is the founder of the now-defunct Tiger Management Corp. Now retired, he invests directly in other hedge funds, and has a network of "Tiger cubs" -- hedge fund managers he mentored while they cut their teeth at Tiger Management.

He is a generous philanthropist, pledging more than half his wealth in line with Bill Gates' and Warren Buffett's Giving Pledge, a charitable effort focused on earning the support of billionaires. He also funds more than 30 full scholarships for students at Duke University and the University of North Carolina at Chapel Hill, his alma mater.

Of more than $3 million in federal contributions Robertson has given since 1996, $2.9 million have gone to Republicans and Republican committees. Robertson could not be reached for comment for this article.

Among other seven-figure donors is Edward Conard, who originally made his $1 million donation under the name "W Spann LLC." Conard is a former managing director of Bain Capital -- the private equity company co-founded by Romney.

Current and former executives at Bain Capital and their families gave at least $3.1 million to Restore Our Future, including two households that contributed $1 million or more.

Conard came forward after numerous media outlets raised questions about the legitimacy of W Spann LLC. Conard could not be reached for comment.

Paul Singer, another $1 million donor, is the founder of Elliott Management, a hedge fund with $19 billion under management. Singer, whose net worth is estimated at $1 billion, made some of his fortune by purchasing debts owed by countries including Peru and the Republic of the Congo and suing them for payment.

Singer is a fiscal conservative and an outspoken critic of the Federal Reserve. But he's not afraid to disagree with the Republican Party's social conservatives. He also supports gay rights and was a key backer of the campaign to legalize gay marriage in New York.

A spokesman for Elliott Management who was familiar with Singer's giving would not comment on the donation.

John Paulson was an early million-dollar donor. He is founder of Paulson & Co., a hedge fund with $22 billion under management. He made $15 billion during the recession by short-selling subprime mortgages, according to multiple news reports. He also could not be reached for comment.

Robert Mercer, another $1 million donor, is president and CEO of Renaissance Technologies, a Manhattan-based hedge fund. Mercer, an NRA member and Long Island resident, earned $125 million in 2011, ranking him 16th among hedge fund managers, according to Forbes. He is a frequent contributor to Republican candidates and causes, notably donating more than $640,000 to Concerned Taxpayers of America.

Though he primarily donates to Republican candidates, including Rep. John Boehner, R-Ohio, and Sen. Pat Toomey, R-Pa., he has also given to Sen. Chuck Schumer, D-N.Y., and former Sen. Chris Dodd, D-Conn., among others. Mercer could not be reached for comment.

Legislative priorities

The Dodd-Frank financial reform act requires investment advisers who manage assets worth more than $150 million to register with the SEC. The firms must provide basic information about their organizational structure, individuals who fill key roles, the types of clients they advise and any conflicts of interest. With registration also comes the possibility of surprise inspections by the SEC.

Investment managers oppose portions of Dodd-Frank because it endangers their business model, said Lynn Stout, a corporate law professor at Cornell University. "Many people have doubts as to whether this sector of the economy is really socially beneficial," she said.

But the issue nearest to the heart and wallets of Romney's former colleagues is undoubtedly carried interest.

Hedge fund and private equity managers don't make money like most working people. They live off the profits generated from investments they manage. Those are considered "capital gains" and are taxed at a maximum rate of 15 percent. If that income were taxed the same as earnings, the rate could be as high as 35 percent.

The relatively obscure issue became big news when Mitt Romney, a beneficiary of the carried interest rule, released his tax returns, which showed he paid about a 14 percent tax rate for 2010 and 2011.

President Barack Obama's new corporate tax plan, unveiled Feb. 23, would treat carried interest as earned income. There are also proposals in both houses of Congress from brothers Sen. Carl Levin, D-Mich., and Rep. Sander Levin, D-Mich., to do the same.

Private equity groups, including Bain, and hedge funds, have lobbied to keep this change from happening. In 2011, the Managed Funds Association spent $4 million on lobbying, the Private Equity Growth Capital Council spent $2.2 million and the National Venture Capital Association spent $2.5 million.

Private Equity Growth Capital Council president Douglas Lowenstein described the proposed change in status as a "punitive 157 percent tax hike [that] will hurt those companies that are most desperately in need of capital to sustain or create jobs and drive growth."

Payday lenders for Romney?

Restore Our Future has also benefited from non-bank lenders that make payday loans, title loans and operate check cashing services. Dodd-Frank imposes federal regulatory oversight of these lenders.

"The payday lenders are under the full power of the CFPB (Consumer Financial Protection Bureau), just as are the big banks," said Ed Mierzwinski, consumer program director at U.S. PIRG. "And it's a very important power, so the payday lenders do not like the CFPB."

Rod Aycox, of Loan Max, and his title loan company Select Management Resources gave $200,000 to the super PAC. His company makes title loans, in which the borrower turns over his car title as collateral and receives a loan at a very high interest rate, usually based on the value of the car.

Las Vegas-based REBS Inc. donated $25,000 to Restore Our Future, listing an address in a shopping center in Las Vegas. State documents show REBS' president is James Marchesi, the founder and president of Check City, a chain of payday lenders, one of which has the same address as REBS in the Las Vegas shopping center.

Marchesi is also on the board of the Financial Service Centers of America (FiSCA), the national trade association for non-bank entities that provide financial services like payday loans, money transfers and check cashing. He could not be reached for comment.

Jones Management Services, run by Allan Jones, gave $35,000. He is also CEO of one of the country's largest payday lenders, Check into Cash Inc.

Payday loans, also known as payday advances, are short-term loans secured against the borrower's next paycheck. These loans often trap borrowers in a cycle of borrowing and high interest, which averages around 400 percent, according to the Center for Responsible Lending.

Other payday lenders that gave money to Restore Our Future are Community Choice Financial, ($30,000), QC Holdings ($25,000), Amscot Corp. ($10,000) and Express Financial Services ($2,500).

Another donor, RTTTA LLC, gave $75,000 and is linked to J. Todd Rawle. Rawle's company Softwise makes software for these lenders. Katsam LLC (spelled "Katsum" in filings), is linked to payday lender Moneytree founders Dennis and David Bassford and gave $35,000. The Bassfords could not be reached for comment.

FiSCA opposes further regulation of financial service centers on the grounds that it "could significantly reduce, if not eliminate altogether, Americans' access to small dollar credit and other financial products," according to its guide to the Dodd-Frank financial reform act.

Donors to Restore Our Future may be hoping for special treatment from a Romney presidency. But given that the candidate is largely with them on the issues already, that might not be the case -- they may just want him to win.

"They view him as far and away the candidate that's most likely to be sympathetic to be preserving business as usual in the financial sector," Stout, the Cornell professor, said. "They've been making a ton of profit and they don't want anyone to stop the party."

Teams to watch during the 2012 Northeast Ohio high school baseball season

Brunswick: The Blue Devils lost their best pitcher and hitter to graduation, but eight of nine position players return from last year's Division I district runner-up team.

Green: Eleven players -- including the top three pitchers -- return from last year's Division I regional runner-up team.

Mayfield: Seven starters, including the top two pitchers, return.

Medina: The Bees won a Division I district championship and while only one full-time starter returns from that team, eight other lettermen are back.

Mentor: This is the most tal-

ented Mentor team since 2007, when the Cardinals finished as the Division I state runner-up.

Notre Dame-Cathedral Latin: If the Lions can manufacture some runs they'll be a tough out. Plenty of pitching and defense on hand.

St. Edward: A young team that will improve as the season goes on and figures to keep pace with the 86-20 record (.811) of the past four seasons.

St. Ignatius: The Wildcats played many underclassmen last year so a veteran team will attempt to reach the always-high expectations.

Shaker Heights: Seven starters return from last year's district

championship team. The Raiders seem ready to duplicate the success of the basketball team.

Strongsville: Matching last year's 20-2 record will be a challenge, but the Mustangs have the hitting, pitching and experience to make a go of it.

Tallmadge: A very experienced and talented group, with six starters returning from last year's Division II regional semifinal team.

Walsh Jesuit: The Warriors have been elevated to Division I for the first time since the early 1990s and will compete with a roster that includes five Division I college scholarship players.

Willoughby South: The Rebels put together a terrific 2011 season -- 25-6 record and a spot in the Division I state semifinals. The Rebels will be good again.

Thinking about a green rating for your new home or remodel? It?s important to know the different rating systems. In addition to building code enforcement, city and state agencies are now requiring some level of green building practice for new construction and substantial remodels.

The most two most widely used green rating systems for residential construction in California are:

GreenPoint Rating
GreenPoint Rated is administered by Build It Green as a green building rating system for new residential construction in California. Points are awarded across five different categories including energy efficiency, resource conservation, indoor air quality, water conservation, and community.

Some individual building departments require new construction to meet standards set by the GreenPointRated checklist, but do not require actual certification.

  • Applies to: single-family or multi-family homes in California

LEED Certification
LEED stands for Leadership in Energy and Environmental Design, a program of the U.S. Green Building Council. LEED certification also awards points across five categories including energy efficiency, site planning, water management, material use, and indoor air quality.

While it was originally designed as a program for commercial office buildings, LEED now has a certification designation for residential design and construction as well.

Toshiba Portege R835-P88


In a world where ultrabooks are hip and happening, ultraportables can seem like yesterday's news. The Toshiba Portege R835-P88 ($849.99 list) is the latest version of a model that's been around for years. It weighs a third of a pound more than the average ultrabook. It has an old-fashioned optical drive instead of a newfangled backlit keyboard. It also costs less than virtually all ultrabooks and runs faster than any of them?and yeah, an optical drive can still come in pretty handy sometimes. For portability, performance, and value (especially at street prices markedly below its $850 list), the Portege R835-P88 is what we said its R835-P50X predecessor was 11 months ago: the epitome of what an ultraportable should be, and an easy successor to last year's model as an Editors' Choice in the category.

Design
The R835-P88 weighs 3.2 pounds on PC Labs' scale?more than the 2.9 pounds of the Apple MacBook Air 13-inch (Thunderbolt) ($1,299 direct, 4 stars) and numerous ultrabooks, though actually an ounce less than our Editors' Choice ultrabook HP Folio 13 ($1,048.99 direct, 4 stars). Its magnesium alloy chassis is a handsome dark blue, accented by chrome (plastic) screen hinges.

The screen feels solid, less flexible or flimsy than that of Toshiba's 2.5-pound ultrabook models such as the Portege Z830-S8302. It's a glossy 13.3-inch panel with the usual 1,366 by 768 resolution; vertical viewing angles are narrow enough that you'll find yourself adjusting its tilt, but horizontal angles are sufficiently broad and brightness and color are fine.

The keyboard, as mentioned, isn't backlit but offers a first-class layout, with dedicated Home, End, PgUp, and PgDn keys plus Ctrl and Delete in their proper lower left and top right corners, respectively. Its typing feel is snappy and sure, if a little shallow. The touchpad works smoothly, its twin buttons giving just the right amount of tactile feedback.

Features
On the right side of the R835-P88's chassis, next to the DVD?RW drive, are headphone and microphone jacks, a USB 3.0 port, and an Ethernet port. On the left are VGA and HDMI ports and two USB 2.0 ports, one an eSATA combo port with Toshiba's "sleep and charge" functionality for recharging handheld devices without turning the laptop on.

Bluetooth and WiMax are absent, but the R835-P88's 802.11n Wi-Fi worked fine in our tests and Intel Wireless Display (WiDi) is on hand for users who want to zap audio and video to an HDTV set equipped with a Belkin or Netgear adapter. Toshiba preloads the system's spacious 640GB (550GB free out of the box), 5,400-rpm hard drive with a slew of house-brand utilities and a scanty 30-day trial of Norton Internet Security.

The diminutive speakers above the keyboard pump out pleasant enough audio, but were occasionally drowned out during our tests by the Toshiba's cooling fan?inaudible during routine productivity work, the latter grew noticeably loud during strenuous exercises such as our graphics benchmarks.

Performance
Toshiba Portege R835-P88 While most Intel Core i5 ultrabooks we've seen use a low-voltage (17-watt) processor running at 1.6GHz, the R835-P88 ultraportable boasts a standard-voltage (35-watt) Core i5-2450M chip running at 2.5GHz. Teamed with 6GB of RAM, it delivers performance that not only bests those flyweights, but even edges Core i7 ultrabooks like the Toshiba Z830-S8302 (1 minute 59 seconds in our Handbrake video encoding test, versus 1:46 for the R835-P88) and Lenovo IdeaPad U300s (4:25 in our Photoshop CS5 image editing test, versus 3:55 for the R835-P88).

Toshiba Portege R835-P88

The R835-P88's PCMark 7 score of 2,313 is only middling, because it has a hard drive instead of one of the SSDs that PCMark 7 adores. But its other benchmark numbers are thoroughly competitive with other ultraportables such as the Lenovo ThinkPad X220 and Panasonic Toughbook CF-S10, leading the field in Handbrake and tying the Lenovo X220 in Photoshop. The only reality check came in our gaming tests, where its Intel HD Graphics 3000 integrated graphics predictably fell short of playable frame rates?plus or minus 21 frames per second in Crysis and Lost Planet 2.

The R835-P88's 66Wh battery will get you through a whole day's work: Though shy of the 9 hours 26 minutes of its predecessor, the R835-P50X (not to mention the 11 hours of the big-batteried Acer TravelMate 8481T-6440), it lasted a solid 8:40?longer than any ultrabook we've tested?in our MobileMark 2007 rundown test.

We've made it clear in other reviews that we're fans of ultrabooks, but the Toshiba Portege R835-P88 is an eye-opener: Almost light enough to forget it's in your briefcase, it delivers ultrabook-beating performance plus the convenience (even if you only use it occasionally) of an onboard optical drive plus the appeal (even if it's mostly due to a hard disk instead of SSD) of a bargain price. At the very least, it's worth keeping our ultraportable category on the books so we can give it an Editors' Choice.

Vance Lecturer discusses ethics, business | Newsroom ...

Mike Baur, the CEO of ScanSource, delivered the 2012 Vance Lecture on Business Ethics on March 29. Baur discussed the progression of the Greenville, SC- based company since he began it in 1992, offering advice to the PC students in attendance.

?I became enamored with the sales side of business and learned how to run my own P&L [profit and loss] at an early age,? Baur said. ?If you can become in charge of a small piece of a business and learn the P&L? the earlier the better? it?s amazing how you change your perspective on things.

?Once you learn the fundamentals, it?s amazing how things make sense to you. I?m not an accountant, but the fundamentals of finance to me are things I?d encourage people to learn at a young age.?

Baur also talked about some of the most common ethical dilemmas that ScanSource employees face.

?Hearing these examples gave our students a clearer understanding about the nature of ethical decisions,? said Dr. Suzie Smith, the Robert M. Vance Professor of Business Administration. ?To prepare them for these inevitable challenges, ScanSource trains them to respond according to their corporate values to promote long term success for ScanSource, their customers, and their suppliers.?

Much of Baur?s lecture related directly to business concepts that Smith and other business professors cover in class: technological developments in enterprise resource planning [ERP] systems and radio-frequency identification [RFID] tags along with the importance of living out corporate values statements and making a profit.

Norman Scarborough, the William Henry Scott III Associate Professor of Entrepreneurship, was most impressed with the way ScanSource, a publicly held company, focuses on doing business for the long term.

?We were pleased that our students could learn from Mr. Baur that doing business the right way and making a profit are not mutually exclusive activities,? Scarborough said. ?In fact, doing business the right way is the best way to create a profitable company.

Where does one get a loan? Usually people start by browsing mortgage providers online, but you can also go to institutional lenders (banks), credit unions, insurance companies, the seller of the property, and, largely, mortgage bankers. Mortgage brokers make up the majority of lenders--more than half, in fact. A mortgage broker acts as an agent between a lender and borrower. Different brokers have different lending contacts, so be sure to do your homework on who you?re hiring. Mortgage bankers, on the other hand, work for a bank and offer bank loans.

JP Morgan Chase and Wells Fargo are too well-known examples of commercial banks. Mortgage lending is not their main business, yet they often provide competitive rates and sometimes even discounts to members. Credit Unions offer mortgages as well.

Here's your basic mortgage vocab lesson for today:

*Amortized Loans
Most mortgages are "amortized loans" where equal payments (usually monthly) of the principal and interest are made over a certain period (usually 15 to 30 years.) The payments cover both the principal and the interest.

*Adjustable vs. Fixed Rate
An adjustable-rate mortgage (ARM) changes the monthly payment based on fluctuating interest rates and usually offers a lower interest rate. A fixed rate mortgage locks in the payment and interest rate for the length of the mortgage. If you can lock in a mortgage at a low fixed rate, woohoo! You win. Interest rates are set by state laws, and charging over that rate is usury.

*Jumbo Mortgages
Jumbo mortgages are home loans that are bigger than normal. They're called jumbo loans because they exceed the "conforming limit," which is the maximum amount that Fannie Mae and Freddie Mac will buy. In Los Angeles, New York City, and other big metro areas, the conforming limit is currently $625,500 and in much of the country it's $417,000. Full list here. Since the recent downturn, jumbo mortgages have become more difficult to get. Expect to put down at least 20% of the down payment and to get an adjustable-rate loan, as fixed-rate jumbo mortgages are relatively rare.

*Conventional Mortgages
Conventional mortgages are loans not made by the VA, FHA, or the Rural Housing Service and are usually offered by banks, credit unions, and savings and loans institutions. Conventionals are categorized as conforming or non-confirming, the prior being acceptable to government-sponsored enterprises such as Fannie Mae and Freddie Mac. These kinds of loan usually require at least 5% down payment; a down payment of less than 20% requires Private Mortgage Insurance (PMI). PMI translates to a percentage of your loan amount.

*Government-Backed Mortgages
Government-backed mortgages are insured by some federal agency. The loan can be made by the private sector, but still receives the insurance of the federal government. The biggies are

-- FHA Loans - insured by the Federal Housing Administration and the most popular type of government loan. You?re required to pay less of a down payment than with a conventional loan, and there?s more leeway if you have qualification roadbumps, but you are going to pay a premium for government mortgage insurance.

-- VA Loans - a program managed by the Department of Veterans Affairs, these loans are available to military servicemembers and their families. VA loans can be used to finance 100% of the home purchase.

*Pre-Qualified vs. Pre-Approved
Pre-qualification is when a mortgage broker informally lets you know how much money you can borrow based on factors including your debt-to-income ratio. (See below.) Pre-Approval is a more intense process where you have to submit financial documentation and then the lender will agree to the loan in writing in a commitment letter. This letter has an expiration date, so make sure you know your timing, because you'll also have to include it in any board package.

*Debt-to-income Ratio
Basically, the percentage of your gross monthly income that goes towards paying your debts. These could be housing related (rent, mortgages, etc) and also debts like school loans and car loans. Check out this calculator to figure out some more details.

*Points
Now, what about points? Points are packets of extra prepaid interest payments that equal 1% of the loan amount. Do you get points for being bad? Geraldo Rivera Apology: Pundit Sort of Walks Back Trayvon Martin Comments


Fox News pundit Geraldo Rivera has issued an apology - or at least a response - to critics of his recent comments on slain Florida teen Trayvon Martin.

Rivera now infamously said (below) that the unarmed 17-year-old's hoodie was to blame for his death as much as George Zimmerman, who shot him.

Realizing how monumentally offensive, insensitive and just plain wrong that comment was, Rivera is now walking back the statement ... partially.

Rivera is standing by his message, and saying that while others took it as pure flame-fanning, he saw it more as honest, accurate and a PSA of sorts.

"I apologize to anyone offended by what one prominent black conservative called my 'very practical and potentially lifesaving campaign urging black and Hispanic parents not to let their children go around wearing hoodies,'" he told Politico.

"My own family and friends believe I obscured or diverted attention from the primary fact, which is that an unarmed 17-year-old was shot dead by a man who was never seriously investigated by local police. And if that is true, I apologize."

But not, he continued, because he was incorrect.

"I remain absolutely convinced of what I said about asking for trouble. There's enough trouble for minority boys not to provoke mad responses from paranoid jerk-offs."

That should simmer everyone down. Probably. Maybe. Okay, not really.
